How long does it take to make a will online.

In most cases, writing a Will online does not take very long. If you have a simple estate then making the will can take as little as 10 minutes, but it will take longer the more complicated your Will is. Some online Will-writing services require a few days for their legal experts to look over the online Will before you are able to sign it.

How much does an online Will cost?

The cost of writing a Will online varies from provider to provider, and on the type of Will you are looking to buy. When you need legal advice

You can get advice from a professional if your will is not straightforward, for example:

Frequently asked questions

If you die without a will, it’s called dying intestate. And the laws of intestacy will decide who should inherit your property, money and possessions. As these laws are over 100 years old, they don’t take modern families into account, like unmarried couples and step children. So, if you and your partner are not married, or haven’t registered a civil partnership, your partner will not inherit all your assets automatically.

If you have a child under the age of 18, in certain circumstances social services or the courts will make decisions about who takes care of them. So writing a will is the best way to protect your loved ones and make your wishes known.

A ‘will trust’ is a way of giving a person, or group of people, control over certain assets when you die. There are different reasons to set up a will trust, for example:

to protect assets for beneficiaries who may not be able to manage them, like leaving property to a young person, or money to someone who is vulnerable

to provide an income or a home for a spouse or partner during their lifetime

to protect money you’re leaving to beneficiaries in certain circumstances, for example, if they are going through a divorce or at risk of bankruptcy

If you write a will with a high-street solicitor, you may need a codicil to change your will. This is a separate document that costs about £70 each time. If you want to make more significant changes to your will, most high-street solicitors would recommend making a new will instead, which can cost hundreds more.

Most married couples, civil partners and long-term partners choose to leave the bulk of their estate to their partner. This is usually due to shared responsibilities, like bringing up children or paying a mortgage, where your partner would rely on your financial support.

If you’re a parent and don’t have a partner, you may wish to share your estate between your children. Anything left to children under 18 will usually be held by your executors until they reach adulthood. Your executors can choose to transfer the gift to the child’s parent or guardian for safekeeping at their discretion, or to use it for the child’s benefit before they reach 18.

If you don’t want to leave your estate to family or close friends, you may choose to include a charity in your will. Leaving a left to charity is a great way to support a cause you care about, and leave a lasting legacy.

Executors are the people you name in your will to carry out your wishes after you die. They could be friends, family members or a professional service – the most important thing is that they would be comfortable carrying out your wishes and administering your estate after you’ve died. Administering your estate could include applying for grant of probate, selling or transferring assets, and distributing your estate to any beneficiaries.

To make your will legally binding you need to make sure it’s signed alongside two witnesses. It’s important that both witnesses watch you sign your will at the same time, then they need to add their own details and signatures. This is so that, if your will is ever contested in the future, your witnesses can testify that they watched you sign your will.

Your witnesses should be people you trust, over the age of 18. They cannot be a beneficiary in your will, or married to one of your beneficiaries.

Inheritance tax is a tax on the estate of someone who has died. An estate can be made up of property, money and possessions.

There’s normally no inheritance tax to pay if either the value of the estate is below £325,000 or if everything above that amount is left to your spouse, civil partner, a charity or a community amateur sports club.

If you own your home (or a share in it) your tax-free threshold can increase to £500,000 if:

you leave it to your children (including adopted, foster or stepchildren) or grandchildren

your estate is worth less than £2 million

Funds from the estate are used to pay inheritance tax. The people who inherit your estate only pay inheritance tax under specific circumstances, for example, if they inherit a rental property, or you give them a gift worth more than £325,000 and die within 7 years.

How long does it take to complete a document?

We suggest you set aside around 1 hour to complete a document, although it can take less or more time, depending on the type of document you're creating and how much information you have to hand.

Do I have to complete my document in a set time period?

No, there isn't a time limit, you are very much in control of when you complete your documents. So you can start, then pause and come back when you are ready. But now you have purchased your documents, we suggest you complete them sooner rather than later.

What happens once I've completed the document?

If you bought a 'Self Service' document, it is now ready to be printed, signed and witnessed.

If you have chosen a document that includes a review, you can now submit it to our specialists by clicking 'Send for review' next to your document. They’ll review it and send you any feedback, guidance and suggestions. Then we’ll send you an email confirming the next steps.

How long does the legal review take?

We aim to complete the review in 10 working days. At busy times it might take slightly longer.

How will I know if my document is legally binding?

With our review service, specialist paralegals go through your document with a fine-tooth comb to iron out errors and to make sure it’s legally compliant. When they’re 100% satisfied that it is, and once it’s been printed, signed and witnessed correctly, it will be legally binding.

What happens once my document has been reviewed?

Once your document has been reviewed, our specialists will return it to you with their feedback. You'll receive an email including the details. If there are no issues, your document will be approved. Alternatively, our feedback could highlight some changes you may need to consider. When you've taken any action needed, send the document back to our specialists to approve by clicking 'Send for review'. Once approved, you can then print your document by clicking 'Print' next to your document in the 'My documents' section of your account. It's really important to follow our guidance to make sure your document is signed and executed correctly. We do not review documents once they have been signed and executed, as this is not part of our service.

If the document is for someone else, do they need to create their own account?

No, all documents are completed within the same account. The person who created the account will be the person that fills in the details for all documents. 

What’s the difference between mirror wills and a pair of wills?

Mirror wills are usually made by married couples or civil partners. Normally, the first to die leaves their estate to the survivor. When the survivor dies, the estate passes to the beneficiaries (who are the same people in both wills).

A pair of wills is two wills made by two people with the flexibility to make them similar to each other or completely different.

Who can witness my will?

In England & Wales, a will must be witnessed by two independent people over the age of 18. Your witnesses don’t need to know what’s in your will.

Witnesses cannot be:

  • beneficiaries in your will,
  • spouses or civil partners of beneficiaries in your will, or
  • anyone related to you.

What type of gift can I make in my will?

  • Specific gifts – such as your jewellery, shares or property
  • Cash – known as ‘pecuniary’ gifts
  • Residuary gifts – what's left after all debts have been paid and all other legacies have been accounted for.

Can I use Which? if I have foreign assets?

If you have assets outside the UK, you can include them in your will. But we cannot guarantee that it will be accepted in the country where your assets are located.

We strongly suggest you take independent specialist advice about whether or not our service is likely to meet your needs.

It depends on the nature of the relationship with your partner upon your death. If you have written a legally valid online will in place at the time of your death, your estate will pass according to the terms outlined within the document.

If you die without a will, your estate will pass according to the rules of intestacy. If you married or in a civil partnership with your partner, they will either get all of your personal property, the first £270,000 of your estate and half of the remaining estate, or all of your personal property and the entirety of your estate with interest from the date of your death, based on whether you have living descendants or not respectively. If you are not married to or in a civil partnership with your partner, they cannot inherit under the rules of intestacy and can only apply to a court for a financial provision.

Likewise, if you are divorced or your civil partnership has been legally ended, your partner cannot inherit under the rules of intestacy.

However, if you are separated from your partner without having divorced or legally separated,they can still inherit under intestacy, following the same procedural rules as married partners or those within a civil partnership.

The original versions of legal documents, such as wills are the only legally binding versions. Scans, photocopies and computer records are not legally valid because they don’t have the original signatures on them. That is why most wills will usually be found at people’s homes, but they can also be stored by professionals or the Probate Service.

Wills written online, as any other kind of will can be registered at the National Will Register. Original wills, stored outside of the house, may be overlooked because executors and beneficiaries are unaware of their existence or location. In consequence, any kind of will, including wills written online, can be tracked through the National Will Register in case the original cannot be easily found elsewhere.

For a online will to be legally valid and binding, it must be signed by and in the presence of two independent witnesses over the age of 18, in addition to the testator themselves being an adult with mental capacity making the will voluntarily.

During the Coronavirus Pandemic, the government amended section 9 of the Wills Act 1837, the legislation dealing with making wills, to allow you to witness a will via a video-call or facetime. This applies to wills made on or after 31 January 2020 and provisionally lasts until 31 January 2024.

There are two main ways to get an online will for free.

Through your trade union or employer – Check whether yours has any partnership with an online will writing service.

Through charities you support – Partnerships between charities and online will writers to provide wills to their supporters. In return, you might consider leaving said charity a legacy.

To write a legally binding will you need to be:

  • A legal adult
  • Have testamentary capacity
  • Making your will voluntarily

Once signed, the legally enforceable parts of your will, such as how your estate is divided, who your executors are and your beneficiaries all become legally binding.

There are three main types of gifts you can include in your online will:

  • Residuary Gift: A percentage share of your estate You can leave certain percentages of your estate to friends, family or charities.
  • Pecuniary Gift: A set amount of money You can also leave a fixed cash gift for example £1,000 to a friend, family member or charity. These gifts come out of your estate first, and then whatever is left over is divided according to your wishes.
  • Specific Gift: A particular item If you have a specific item that you want to give someone you can do this too, such as a car or jewellery, or a work of art.

If you die without a will in place, your assets are dealt with according to laws of 'intestacy'. These laws are the government's way of deciding how everything you own is split up. However, the persons who inherit under intestacy may not be the persons you want to ultimately receive your assets.

Dying without a will could then cause additional stress and complications to your loved ones at an already distressing time. Therefore, making a will is one of the most important things you can do to make sure that your wishes are clearly laid out to deliver the outcome that you want and ultimately will give peace of mind to your loved ones.

If you’re in a civil partnership when you die your will will be dealt with in the same way as a married couple.

This means that if you have a will then the wishes laid out in your online will will be followed.

If you don’t have a will in place then your estate will be divided up according to the rules of intestacy. When you have a civil partner this means that your surviving partner will inherit all of the personal property that belonged to you and the following depending on whether you have any surviving descendents…

If you have surviving descendents e.g. children then your partner will get:

  • The first £270,000 of your estate (everything else you owned) and half of the remaining estate.
  • Your surviving descendants e.g. children will get the other half of the remaining estate.

f you don’t have any surviving descendents then your partner will get everything.

If you have a legally valid will in place, your will will determine what happens to your estate, gifts and any children under 18 years old.

However, if you don’t have a will in place it’s a little more complicated.

If you have a partner, but you aren’t married your estate will be divided up according to the rules of intestacy. Intestacy rules only provide for married partners or blood relatives.

This could mean that your partner gets nothing if you’re not married. They can always apply to the court for financial provisions to contest this.

If you don’t have a partner when you die, your estate will be divided up according to the rules of intestacy. Intestacy rules provide for any of your blood relatives or other close relatives if you don’t have children or grandchildren.

Mirror Wills are two wills, for two different people, usually a married couple, that have virtually identical wishes.

E.g they might both want to leave the entirety of their estate to their respective partner, with their children as back up beneficiaries.

It is a great way to communicate joint wishes simply.

However, whilst both wills are mirrored, they are still separate legal documents.

So if any major changes occur, both people need to update their online wills to ensure they are still matching.

An executor is the person named in a will who is responsible for sorting out the estate of the person who has died.

In order for a will to be legally valid, it has to be witnessed and signed by two independent adults. They are there to check that the will writer knows what's happening and isn't being pressured into signing.

A witness must be over 18 years old.

They can't be:

  • Related to the will writer
  • A beneficiary of the will
  • Married or in a partnership with any beneficiaries

Most people choose neighbours, friends or colleagues as their witness. You can also choose a professional such as a solicitor or GP.

Firstly, if your children are under 18, it is important to write a will so that you can have a say in who would look after them if you and any co-parents or guardians were to die. If you and any co-parent or guardian were to die the court will appoint guardians, which might not reflect your wishes.

Secondly, it allows you to provide for them, either directly if the child is over the 18, or through a trust, for children under 18.

Lastly, sorting your Will allows you to give particular items you own to your children, ranging from practical gifts like a car to sentimental ones.

If you’re a homeowner your will is the place you can say who you’d like to inherit it - and the same applies to any money, savings or possession that you have.

If you own the property on a ‘joint tenant’ basis, your share of the property will automatically pass to the other co-owner on your death. However, if you own the property on a ‘tenant in common’ basis, your share in the property will pass using the rules of intestacy if you do not have a Will, meaning it would pass to your closest living relative according to government rules, which might not reflect your wishes.

Worth also noting that in light of the challenges around COVID, the government have responded by introducing new legislation that will allow wills to be witnessed remotely using video conferencing tools such as Zoom, WhatsApp and Facetime.
